Appellant was charged by indictment with the offense of operating an automobile in the city of Indianapolis while he was under the influence of intoxicating liquor and that theretofore he had been convicted of a like offense. He entered a plea of not guilty and was tried by the court without the intervention of a jury. The trial resulted in a finding and judgment of guilty.
