The indictment, returned March 13, 1952, charged defendant with the crime of "larceny of domesticated and restrained animals, towit: cattle * * * the property of one Kenneth Charter, contrary to and in violation of Section 709.8 of the 1950 Code of Iowa [I.C.A.] * * *." The date was alleged as "on or about December 31, 1951."
