SCHOTTKY, J.

The appellant, Birchie H. Jordan, was convicted by a jury of first degree murder and his punishment fixed at life imprisonment. This appeal is from the judgment entered in accordance with said verdict. No motion for a new trial was made. This case is before this court for a second time, the previous conviction and judgment of first degree murder having been reversed in People v. Petree, 109 Cal.App.2d 184
