On November 28, 1950, plaintiff Cyr, in the course of his employment as a construction laborer, fell without fault on his part into an unguarded elevator shaft. The sole question presented on this appeal is whether there is evidence in the record to support the finding that defendant was responsible for the dangerous unguarded condition of the shaft.
