This was an action for the purchase price of certain merchandise alleged to have been sold and delivered by plaintiff to defendant. The defense pleaded was that the goods were shipped to defendant under an agreement that they could be returned and that they were returned. The secretary-treasurer of plaintiff corporation was its sole witness in chief and during the course of his testimony he stated that about the time the order for the goods...
