On December 31, 1952, an opinion, 94 A.2d 385, was filed in this cause directing that the judgment below be reversed. Thereafter, the appellee was granted limited reargument on the question of the proper application of 1935 Code, § 45891 which in part is as follows:

"Suits may be brought against any corporation, at law by summons...
