This is an appeal from the final judgment in a personal injury case.

The first question to be answered is whether or not the trial court should have directed a verdict for the defendant because the plaintiff had failed to prove any negligence on the part of the defendant or that the evidence as to contributory negligence on the part of the plaintiff was so conclusive that there was nothing to submit to the jury.
