This action of trespass on the case for negligence was tried to a jury in the superior court and resulted in a verdict for the plaintiff in the sum of $5,600. Thereafter the defendant filed a motion for a new trial which was denied provided plaintiff remitted all of the verdict in excess of $4,150.
