OPINION BY HIRT, J., January 20, 1953:

The indictment in this case charged defendant with setting up a lottery, and with managing, conducting and carrying on the same, in violation of Section 601 of The Penal Code of June 24, 1939, P.L. 872, 18 PS § 4601. He was found guilty by a jury on both counts and a single sentence, to pay a fine of $150, was imposed.
