The respondent brought this suit under the Federal Employers Liability Act, 45 U.S.C.A. § 51 et seq., to recover damages for personal injuries received while engaged in his duties as an employee of the appellant. From a verdict and judgment for the plaintiff in the sum of $5000 the defendant has appealed.
