This is an action to recover a balance due on a contract with the defendants, as the Board of County Commissioners of Hamilton County. The issues were submitted to the court without a jury. There was a finding and judgment for the defendants. The plaintiff's motion for a new trial was overruled and thereupon, in due time, this appeal was filed.
