Now on this 1st day of April, 1953, there comes on for hearing a purported appeal by the petitioner, Carl Austin DeWolf, from an order of the district court of Tulsa county striking a motion for new trial from the files of said court by reason of lack of jurisdiction in said court to hear said motion. The motion was based on the ground of newly discovered evidence.
