This suit was brought by complainant carrier to recover demurrage charges in the sum of $787.95 alleged to be due from defendant warehouse company on some 59 cars of scrap iron consigned and delivered to defendant and handled for its account, pursuant to an "average demurrage agreement" by which it promised to pay such demurrage charges to complainant.
