OPINION OF THE COURT BY LE BARON, J.

This is an action in tort for damages arising out of injuries suffered by the plaintiff when he was struck by the defendant's automobile while crossing a public highway. The action was tried before a jury which rendered a verdict for the defendant. In accordance therewith, judgment was entered from which the plaintiff sued out the instant writ of error.
