On November 3, 1945, Melba I. Logan, the defendant in error herein, filed suit in the district court of Garfield county, Oklahoma, against Lewis E. Logan, seeking a divorce, the petition alleging residence; cruel treatment; that the property jointly owned by the parties was homestead, and asking for a divorce, custody of a minor child, and that she be awarded the real estate as alimony and support and maintenance of the child.
