The plaintiff Kimble brought this action against the defendant Willey in the United States District Court for the Eastern District of Arkansas on December 30, 1948. The action was one to quiet title to certain lands in Arkansas of which the District Court had jurisdiction because of diversity of citizenship of the parties.
