The defendants, Arnold's Pharmacy, Inc., a corporation, Richard Leipert, its Treasurer and Manager, and Max Rosenthal, its pharmacist, were all indicted for violating the Federal Food, Drug, and Cosmetic Act, commonly known as the Pure Food and Drug Act, as amended June 25, 1938, chapter 675, 52 Stat. 1040, Title 21 U.S.C.A. § 301 et seq.
