Appellant was convicted for the offense of driving an automobile upon a public highway while intoxicated, and his punishment was assessed at one year in jail and a fine of $100.

Earl Weatherly testified that he saw an automobile stopped at a stop sign and that it then proceeded north across a street intersection and was struck by appellant's automobile which was travelling west; that he helped lift the other automobile off of a man pinned...
