CHAPPELL, Justice.

An information filed by the State charged plaintiff in error, hereinafter called defendant, with statutory rape upon a young lady 14 years of age. The crime was allegedly committed by him on October 8, 1952, when he was aged 18 years and upwards. Defendant pleaded not guilty, but after trial to a jury he was found guilty with a recommendation for leniency. His motion for new trial was overruled, and he was sentenced to serve 4 years in the penitentiary...
