On September 2, 1951, appellant killed his son-in-law, one Bobbie Lynn Haley, in Denham Springs, Livingston Parish, by shooting him with a shotgun. He was prosecuted for murder and, following a mistrial occasioned by the inability of the jury to reach a verdict, the district attorney nolle prosequied the indictment and filed a bill of information charging him with manslaughter.
