ROBINSON, Justice.

This is a personal injury case; there was a verdict for the defendant in a jury trial; the plaintiff has appealed and urges for reversal two of the assignments of error set out in the motion for a new trial; first, that the verdict is contrary to the evidence, and second, the giving of Instruction No. 13 at the request of the defendant.
