Respondent, David Arthur, hereinafter referred to as the defendant, is a Nez Perce Indian and a member of the Nez Perce tribe of Indians. He was charged with killing a deer out of season, on September 26, 1951, in Idaho County, on National Forest lands, outside the boundaries of the reservation but within the exterior boundaries of lands ceded to the federal government by such Indian tribe, in violation of Section 36-104, I.C., and the regulations...
