The defendant, Walter Nihipali, was indicted by the territorial grand jury on August 9, 1951, for the offense of negligent homicide, the indictment being in substance that on June 24, 1951, the defendant operated a motor vehicle so carelessly and negligently as to cause the vehicle to go off the road, collide with an electric pole and turn over, thereby causing one Charles Kaahu, a passenger...
