POWELL, P.J.

Theodore Harris has appealed from a conviction in the district court of Tulsa county of the murder of his common-law wife, Princella. The jury assessed a penalty of life imprisonment in the State Penitentiary.

For reversal two specifications of error are assigned:

"1. Admission of incompetent evidence, to-wit: the testimony of Kenneth Washington, a five-year old witness, on behalf of the State.

"2. That the evidence is wholly insufficient...
