Appellant Truman Green instituted this suit, in his own behalf and as next friend of his minor daughter, for damages resulting to them from a park swing having come apart while she was swinging in it. Certain facts of actual negligence on the part of the city were alleged and proven. The issues were submitted to a jury, which returned a verdict for both the father and daughter.
