This is an action for the recovery of certain income taxes which the plaintiff alleges were illegally assessed and collected. The Commissioner of Internal Revenue, in computing profits on automobile sales, had refused to recognize as part of the cost price sums expended by the plaintiff in excess of established ceiling prices.
