The sole question presented on this appeal is whether or not the appellee, S. Guy Garner, as the executor of the estate of H.H. Yates, deceased, is liable for an attorney's fee on the promissory note sued on, and which was executed by L.H. Oakley and the said H.H. Yates on October 31, 1950, in favor of the appellant, The Peoples Bank and Trust Company of Tupelo, Mississippi, for the principal sum of $3,700.00...
