BLISS, Justice.

Although chapter 391A. of the 1950 Code of Iowa was repealed by chapter 156 of the Laws of the 54th General Assembly, approved May 2, 1951, during the construction period of the public improvement, the provisions of the repealed chapter control the determination of this action.

At a meeting of defendant's council on December 11, 1950, adjourned from December 4, 1950, it adopted a "resolution Directing the Preparation of Preliminary Plans, Specifications...
