This appeal comes to this court on questions of law and fact from a judgment of the Common Pleas Court of Cuyahoga County, dismissing the plaintiff's petition where an injunction was prayed for to prevent the defendant from trying a condemnation proceeding seeking to take plaintiff's property as a necessary step in the building of a rapid transit system for public transportation in the city of Cleveland.
