SMITH, Justice.

This is an action ex contractu against S. S. Hall, Jr., sheriff and resident of Fauquier county, Virginia, principal, and the United States Fidelity and Guaranty Company, a Maryland corporation, surety, for the alleged breach by Hall of the condition of his official bond, by acts committed in Prince William county.
