Dorothy Cronin brought this action in the district court for Douglas County against Dale Swett. It is a tort action based on alleged negligent conduct of defendant in driving his car while plaintiff was riding therein as a guest. This conduct, it is alleged, caused the car to leave the paved surface of the highway and crash into a ditch, resulting in plaintiff being seriously injured.
