Harbert as plaintiff filed suit in the district court for Lancaster County on March 15, 1952, to recover damages for personal injuries and damage to his automobile alleged to have been sustained by him, caused by the negligence of Victor Mueller as defendant when the defendant drove his automobile into the rear of the plaintiff's automobile.
