This is an appeal upon questions of law from a judgment of the Court of Common Pleas of Allen County in an action wherein the appellee, Donald A. Vorum, is plaintiff and the appellant, Thomas Gorman, is defendant.

The action is one for the recovery of damages for injuries alleged to have been sustained by plaintiff through the negligence of defendant in a collision between a Crosley automobile, in which the plaintiff was riding as a business guest...
