On appeal from the Malvern Municipal Court, the defendant was convicted in Circuit Court of the crime of contributing to the delinquency of a minor by indecently molesting an eight year old girl.

Although the information stated a date upon which the offense was alleged to have been committed, there was a total failure of proof on this point. The defendant contends that the city's failure to prove that the offense occurred within one year...
