SCHWELLENBACH, J.

At about 10.45 p.m. on August 21, 1950, Mr. Hammerbeck was driving his automobile along the old Buckley-Sumner highway in Pierce county. Suddenly a horse jumped from the side of the road, striking the side of the car. The automobile was damaged, and Mr. Hammerbeck received severe injuries.

Mrs. Richardson owned the farm adjacent to the scene of the accident. The horse was kept on the farm. In 1946...
