This is an action for damages for breach of an alleged agreement to convey certain real property to the plaintiff by will.

The plaintiff, who lived in Illinois, is the nephew of the defendant, who lived in California. In November, 1941, the defendant acquired by inheritance 80 acres of land in Illinois, which was known as "Westland."
