JONES, J.

The defendant Tillie Littke was charged by an information filed in the county court of Custer county with the unlawful possession of whiskey; was tried, found guilty by verdict of the jury, who left the punishment to be fixed by the court. Thereafter, the defendant was sentenced to serve 30 days in the county jail and pay a fine of $250 and has appealed.
