BARKSDALE, District Judge.

At the conclusion of a three-day trial of this case with a jury, on the evening of May 8, 1953, the jury returned a verdict for the plaintiff in the sum of $15,000 and judgment was entered thereon. Both plaintiff and defendant have now filed motions for a new trial. As to plaintiff's motion, there can be no question of its timeliness, because it was both served upon counsel for the defendant and filed in the Clerk's Office within ten days...
