The plaintiff in error, Mack Flinn, defendant below, was charged by information in the county court of Choctaw county, Oklahoma, with the unlawful possession of intoxicating liquor, to wit, 55 fifths, 385 pints, 816 one-half pints tax paid whiskey and 24 fifths of wine tax paid, in violation of Title 37, § 31, O.S.A. 1941. The offense was allegedly committed in Choctaw county on August 12, 1950. The defendant was tried by a jury, convicted, his punishment...
