This case is before the court on defendant's motion in arrest of judgment under the Act of June 15, 1951, P. L. 585, sec. 1, 19 PS §871, or in the alternative for a new trial.

Aaron Turner was convicted of murder in the first degree and the penalty was fixed at death by a jury at the conclusion of a two-day trial conducted on January 12 and 13, 1953. This was Turner's fourth trial on an indictment...
