On November 12, 1947, plaintiff's vehicle collided with a vehicle owned by the State of New York and operated by defendant. Plaintiff filed a claim against the State in the Court of Claims for property damage and thereafter commenced this action in the Supreme Court against defendant. Plaintiff's claim against the State resulted in a judgment of the Court of Claims finding that plaintiff failed to establish freedom from contributory negligence, which judgment was affirmed...
