On September 10, 1952, plaintiff filed in the district court a criminal information charging the corporate and individual defendants with numerous violations of the Fair Labor Standards Act of 1938, as amended, 29 U.S.C.A. § 201. Defendant Rominger moved to quash service on the corporate defendant and to dismiss the information as to it upon the ground that the corporation had previously been dissolved.
