Judgment, insofar as appealed from, modified on the law and the facts, by striking therefrom the first ordering paragraph and by substituting in place thereof a provision granting plaintiff a separation. As so modified, the judgment is unanimously affirmed, with costs to appellant.

Further, the matter is remitted to the Special Term for further proceedings not inconsistent with the views stated herein. Findings of fact inconsistent herewith are reversed and new findings...
