This case is a companion case of People v. Bennett, post, p. 601, decided this term, wherein we reversed the conviction in that case for the reasons assigned. The defendant in this case, Everett Kirkpatrick, was likewise found guilty of the crimes of burglary and larceny by a jury in the circuit court of McDonough County.
