The defendant Ray was convicted in the District Court for the Eastern District of Oklahoma upon two counts of an indictment. The first charged possession of nontax paid whisky, and the second charged the defendant with concealing non-tax paid whisky. The defendant was arrested in open country while fleeing from a pickup truck which he had been driving, and a quantity of whisky was observed in the truck and seized.
