The transaction on April 12, 1950, in which the defendant sold to the plaintiff a 1937 model Olds-mobile for the sum of $250 was productive of litigation. It originated by the institution on May 10, 1950, of an action by the plaintiff against the defendant in the Hudson County District Court which terminated in the granting of a voluntary dismissal without prejudice.
