Plaintiff sought a writ of mandamus in her favor and against the defendant and thereby endeavored to have the district court direct the defendant board to issue to her a state beer permit. The defendant filed a motion to dismiss the petition on the grounds that there was no mandatory duty imposed upon it by law to issue such a permit as referred to in plaintiff's petition and for the further reason that the district court did not have jurisdiction...
