This is an action of trespass on the case for negligence brought by a servant against his masters for personal injuries sustained by him in the course of his employment at their bottling shop. Since the defendants did not come within the provisions of the workmen's compensation act, the case was tried in the superior court under the principles of the common law governing the relation of master and servant.
