These actions which have been consolidated for trial are cross-suits arising out of the break-up of the Tanker Esso Manhattan on March 29, 1943 while outbound in ballast in the swept channel approach to New York harbor. The central issue involved is whether the breakup of the vessel was due to a war risk.
