Appellant was convicted of the offense of sodomy and assessed a penalty of two years in the penitentiary.

The offense is alleged to have been committed late at night on November 23, 1950. The prosecuting witness testified that he was returning to his home alone after attending a show and, as he crossed through an underpass, he saw appellant sitting in a car by the side of the street; that appellant called to him and asked for a cigarette...
